Apex Holding: Struck down Section 17(2) of the SARFAESI Act as unconstitutional and violative of Article 14 for imposing an onerous 75% pre-deposit condition at the initial stage of adjudication. Affirmed that the borrower is entitled to present objections to the Section 13(2) demand notice and the secured creditor is under a statutory obligation to consider them and communicate reasons for rejection.
In Plain Words: Borrowers have an absolute, unconditional right to file a Securitisation Application before the DRT under Section 17 without paying any upfront deposit. Furthermore, banks cannot ignore borrower representations under Section 13(3A); they must issue a reasoned speaking order within 15 days before taking possession.
M/S Transcore v. Union of India & Anr.
(2008) 1 SCC 125 ยท Decided: 29 November 2006
Apex Holding: Held that the remedies available to secured creditors under the RDDB Act 1993 and the SARFAESI Act 2002 are cumulative and complementary. The doctrine of election has no application. The bank is not required to seek leave or withdraw its pending Original Application (OA) in the DRT before initiating SARFAESI enforcement measures.
In Plain Words: A bank can sue a borrower in the DRT for a money recovery decree and simultaneously seize and auction the mortgaged factory or home under SARFAESI. The two recovery mechanisms operate simultaneously.

Apex Holding: High Courts must exercise extreme caution and circumspection in entertaining writ petitions under Article 226 when an efficacious alternative statutory remedy is available under Section 17 of the SARFAESI Act. Granting routine stays against commercial recoveries bypassing DRT undermines the statutory purpose of Parliament.
In Plain Words: High Courts will ordinarily dismiss direct writ petitions challenging bank possession or auction notices and direct the borrower to file a Securitisation Application before the DRT, unless exceptional circumstances of complete lack of jurisdiction or gross constitutional violations exist.

Apex Holding: Under amended Section 13(8) of the SARFAESI Act, the borrower's statutory right of redemption is definitively extinguished upon publication of the public auction notice in the newspapers. Borrowers cannot derail a public auction or frustrate a bona fide auction purchaser by attempting redemption after publication or bid closure.
In Plain Words: A borrower cannot wake up after the auction is announced or bids are received to stop the sale by offering payment. Auction purchasers who participate in good faith and deposit funds enjoy absolute statutory finality.
